A void civil marriage is a marriage that has never come into existence, as if it never
happened. It is void from the outset due to non-compliance with formal or material
requirements for a civil marriage, such as being solemnized by someone who is not a
competent marriage officer or one of the parties being mentally ill.
On the other hand, a voidable civil marriage is a marriage in which grounds are present,
either before or at the time of the wedding, that allow the court to be requested to set the
marriage aside. These grounds can include circumstances such as minority (lack of
necessary consent from a minor's parent or legal guardian), material mistake, duress,
undue influence, stuprum (pre-marital pregnancy without the husband's knowledge),
impotence, or fraudulently concealed sterility.
