This assignment is about Lesson 2 COPYRIGHT, in conjunction with Lesson 1
INTRODUCTION.
Note that you have a choice of questions. Each of the six questions counts 10
marks. You may choose any four questions for 40 mark, e.g. Questions 1, 2, 3.1 and
5, or Questions 2, 3.1, 3.2 and 4 – any combination that you prefer. If you answer all
the questions we will only mark the first four answers. Even though you only have
to submit four answers, we advise that you still consider all the questions, as
engaging with the assignment as a whole may assist you in answering your chosen
questions.
Accurate answers are required. You are expected to refer to legislation and court
decisions, where applicable. Acknowledge your sources in footnotes or in the text itself,
and in your Bibliography at the end of the Assignment.
DO NOT CUT AND PASTE ANSWERS FROM THE LESSONS OR ANY OTHER
SOURCE. You may not repeat the wording from any source, including the study material,
without properly attributing it as a quotation. As no (or few marks only) will be given for
direct quotations from any source, quotations are an absolute waste of precious space. It
is imperative to use your own words to convey your understanding of the work.
The text must be typed in Arial font, size 12 with single line spacing within the paragraph,
and double line spacing after the paragraph. Your answer (for the whole assignment)
should not exceed 2 typed pages (or 3 hand-written pages), excluding your cover page
and Bibliography. As all the questions count 10 marks each, you can spend about 1/2
page on each question. As accurate application is what counts, two typed pages is enough
space for answering this assignment.
The questions are based on the following fictional scenario, which then further unfolds
during the course of the assignment:

, Letitia is the freelance editor of the kids’ page of the South African FamilyFun magazine.
A very popular activity on the kids’ page is the connect-the-dots puzzles that Letitia
creates from her own line drawings. Letititia is approached by EsTee Publishers, who is
interested in publishing fifty of her connect-the-dots puzzles that had appeared in
FamilyFun as a children’s activity book.

Answer any four questions for 40 marks.
You can accept that copyright subsists in Letitia’s artistic works.
Question 1
Does EsTee Publishers need FamilyFun’s permission to use Letitia’s connect-the-dots
activities? Your answer must consider all five paragraphs of section 21(1) ((a) to (e)), as
well as other relevant provisions of the Copyright Act 98 of 1978.

Question 2
Letitia contacts the Department of Education to enquire whether they would be interested
in “buying” 30 of her more complicated, unpublished connect-the-dots puzzles that are
suitable for grade 4 and 5 learners. They express great interest, and would also like her
to create a series of connect-the-dots activities for use by mathematics teachers (featuring
dot patterns like 1, 2, 4, 8, 16, 32, 64, 128… and 4, 8, 12, 16, 20, 24, 28…) For the math
project she will have to work closely with expert employees of the department. They want
