Week 1: introductie- Europees en internationaal strafrecht vanuit Nederlands perspectief -
Europees strafrecht is een complexe wisselwerking tussen het Europees recht en
nationaal recht met een sterkte beïnvloeding door het Internationaal strafrecht
(rechtsgebied met veelvuldig gebruik van hybride en gelede normstellingen). Er
dient een onderscheid gemaakt te worden tussen de Europese Unie (EU) en de Raad
van Europa (Europa). Alle leden van de Europese Unie zijn lid van de Raad van
Europa. Dat heeft een enorme invloed op de rechtsinstrumenten die worden
gebruikt binnen de Europese Unie.
Het Verenigd Koninkrijk heeft een handels- en samenwerkingsovereenkomst
gesloten met de Europese Unie na de uittreding. Hierin staan bijvoorbeeld
afspraken over de uitwisseling van PNR-gegevens en samenwerking met EUROPOL
en EUROJUST. Binnen de Europese Unie bestaat de mogelijkheid dat bepaalde
lidstaten verder willen gaan qua nauwe samenwerking. Een voorbeeld hiervan is het
EOM (Europees Openbaar Ministerie). Sinds 2022 maakt Rusland geen deel meer uit
van de Raad van Europa. Dit is het overkoepelend orgaan waardoor het Europees
strafhof valt.
De algemene internationalisering van de strafrechtspleging valt uiteen in het VN-
verdrag, multilaterale verdragen en bilaterale en multilaterale akkoorden. De visie
van de cursus is het Europees strafrecht in een internationale context vanuit
Nederlands perspectief met focus op EU-strafrecht op uniestrafrecht.
Er is geen algemeen wetboek internationaal strafrecht. Wel is er een reeks aan
bijzondere wetten (Uitleveringswet, overleveringswet, WOTS, Wet Internationale
misdrijven, etc.). Daarnaast zijn het wetboek van Strafrecht en Wetboek van
Strafvordering van belang op nationaal gebied.
,Voor het strafprocesrecht is van belang de internationale strafrechtelijke
samenwerking. Dit zijn verschillende vormen van justitiële samenwerking:
uitlevering (ter strafvervolging of ter strafexecutie), overdracht van strafvervolging,
overdracht van strafexecutie en wederzijdse rechtshulp. Daarnaast zijn er ook
verschillende vormen van politiële samenwerking. Het materiaal strafrecht is meer
georganiseerd zoals EU-misdrijven, terrorisme, mensenhandel en internationale
core crimes.
