Right to a basic education
The right to a basic education is enshrined in section 29(1)(a) of the Constitution of the
Republic of South Africa, 1996. This right is considered a fundamental right and is a crucial
aspect of the Bill of Rights in South Africa. In the case of Governing Body of Rivonia Primary
School & Another v MEC for Education: Gauteng Province & Others, the constitutional court
confirmed that the right to basic education is not subject to progressive realization. This
means that the right to a basic education under section 29(1) is immediately realizable
without any internal limitations or requirements for progressive realization within available
resources.
