1.2 Explain the ordinary civil method of the computation of days with reference to the

ANSWER:
The ordinary civil method is the default method for calculating months and years [1]. In terms of
this method the first day of the period is included [1] and the last day is excluded [1]. The last
day therefore ends as soon as it begins [1]. This method was applied in Minister van Polisie v
De Beer 1970 (2) SA 712 (T) [1] when the court was called upon to determine if a claim for
damages which had to be instituted within a 6-month period in terms section 31 of the Police
Act 7 of 1958 (the “Act”) had been filed timeously [1]. The Supreme Court applying the ordinary
civil method in its interpretation of the Act held that because of the last day being excluded a
summons filed 6 months prior was served 1 day too late [1].
