QUESTION 1 Answer the following questions regarding the South African Law
Reform Commission: 1.1 Describe the working method of the Commission as
mentioned in your HFL1501 Study Guide. (3) 1.2 Read the following
statement and answer the questions that follow: “It appears that the
Commission does not hesitate to [refer to] the civil-law heritage that we share
with other European legal systems.” (a) Explain what is meant by “civil-law
heritage”. (1) (b) South African law consists of three components. Our civil-law
heritage falls under which one of these three components? (1) [5]

1.1 The working method of the South African Law Reform Commission
(SALRC) involves conducting research, consulting with stakeholders, and
making recommendations for reforming and modernizing the law. This
process typically begins with identifying areas of the law that require review
and reform, followed by conducting thorough research and analysis. The
Commission then consults with various stakeholders, including legal experts,
government officials, academics, and the public, to gather input and
feedback. Based on this research and consultation, the SALRC formulates
recommendations for legislative changes or reforms to improve the legal
system and address any deficiencies or gaps in the law.

1.2 (a) "Civil-law heritage" refers to the legal traditions, principles, and
practices derived from the Roman law system that have influenced the
development of modern legal systems in Europe and other regions. It
encompasses legal concepts such as codification, the emphasis on written
laws and statutes, and the use of judicial precedent to a lesser extent
compared to common law systems.

(b) South African law consists of three components: Roman-Dutch law,
English law, and Indigenous law. Our civil-law heritage falls under the
Roman-Dutch law component, as South Africa inherited much of its legal
system from the Roman-Dutch legal tradition through Dutch colonization and
subsequent British rule.
