Summary of the Case:
Littlejohn v Norwich Union Fire Insurance Society involved a husband, Mr. Littlejohn, who
had insured property belonging to his wife, Mrs. Littlejohn, under a fire insurance policy.
The property, including the business, was under the control and management of Mr.
Littlejohn, who derived a benefit from its existence. The insurance company raised
defences, including the lack of insurable interest and failure to disclose ownership, but the
court ultimately ruled in favor of Mr. Littlejohn, confirming his insurable interest and ability
to sue in his own name. Additionally, the court held that a change in the nature of occupancy
did not necessarily include vacancy, therefore dismissing the insurance company's defense
on that basis.
