The South African Constitution prohibits discrimination on several grounds. With
the use of caselaw, explain direct and indirect discrimination in terms of section 9
of the Constitution. [2 marks]
Direct discrimination occurs when a law or conduct explicitly treats a person or group
differently based on a prohibited ground, such as race, gender, or age. In the case of
City Council of Pretoria v Walker, the council's actions were found to indirectly
discriminate on the basis of race, despite being neutral on its face, as it imposed more
burdensome tariff structures and debt-collection policies on suburbs with predominantly
white residents. This case illustrates how indirect discrimination occurs when a law or
policy, while appearing neutral, has a disproportionately negative impact on a certain
group based on a prohibited ground.
