The fact that South Africa has an uncodified legal system means that the laws and legal
principles are not all contained in a single, comprehensive code. This can complicate the
process for a lawyer searching for a remedy with regard to a legal question because they
must navigate through a wide array of sources to find relevant laws and legal principles.
They will need to consider the Constitution, legislation, judicial precedent, common law,
custom, and indigenous African law, in addition to the various components of the legal
system such as Roman, Roman-Dutch, and English law. This can make the process of
finding and applying the relevant laws more complex and time-consuming, requiring a
thorough understanding of the different sources of law and how they interact. It may also
require legal research skills to effectively navigate through the varying sources and
determine the most appropriate remedy for a legal question.
