Briefly explain the operation of the stare decisis rule. (3)
The doctrine of stare decisis literally mean ‘the decision stands’. The Judge makes a
decision and parties must adhere to his decision. The doctrine of Stare Decisis would
mean that a later court would be bound by the earlier decision regardless of whether or
not the earlier decision could be regarded as correct.
QUESTION 2
Mr Zondo invited 100 guests to his 50th birthday party held at an upmarket hotel in
Mbombela.
The hotel agreed to provide catering at the cost of R450.00 per guest. In order to avoid
incurring additional costs, Mr Zondo had stated expressly on the birthday invitation that
none of the invitees should bring their children. Ten parents brought 10 children to the
party. Consequently, the hotel charged Mr Zondo an additional cost of R200.00 per child.
Explain whether Mr Zondo may claim the additional costs from the children’s parents. (5)
