Section 59A(1) of the CPA allows a Director of Public Prosecutions (DPP) or an authorized
prosecutor, in consultation with the police investigating officer, to authorize the release of an
accused on bail for certain specified offences. The offences for which prosecutorial bail can be
granted are listed in Schedule 7 of the CPA. These offences include, but are not limited to,
public violence, culpable homicide, assault involving the infliction of grievous bodily harm, arson,
housebreaking, and various other offences where the financial amount involved does not
exceed R20 000.
Application to Facts
Murder is defined as the unlawful and intentional killing of another human being. This offence
is not listed in Schedule 7 of the CPA, which enumerates the specific offences for which
prosecutorial bail may be granted. The offences in Schedule 7 are generally considered less
severe compared to the gravity of murder, which is one of the most serious crimes in criminal
