INTRODUCTION
The Republic of Qrose's abortion law, as codified in Article 116 of the Penal Code of 1935, is
one of the most restrictive in the world, permitting abortion only to save the life of the woman.
This legal framework has resulted in severe violations of women's rights, as illustrated by the
case of Tambu, a 13-year-old girl who was denied an abortion after becoming pregnant due to
rape. Given Qrose's ratification of several international human rights instruments, including
CEDAW and its Optional Protocol, the African Centre for Women Justice (ACWJ) seeks to
challenge the constitutionality of Article 116 before the CEDAW Committee. This legal opinion
will address the procedural issues of admissibility, the substantive rights infringed by Qrose's
law, and the remedies that can be claimed, ultimately demonstrating that Qrose's abortion law
is inconsistent with its international human rights obligations.
