Harmonisatie (boek p. 200)● Art. 114 VWEU (dia 13):
- REGEL:
Lidstaten kunnen in principe de uitzonderingen in het hoger belang,
uitdrukkelijk voorzien in art. 36 VWEU of de ‘dwingende redenen van
algemeen belang’ (rule of reason) niet meer inroepen
- VOORWAARDE:
indien, en in de mate dat, er een harmonisatieregel is genomen op
grond van art. 114 VWEU die in de bescherming van deze hogere
belangen voorziet (Denkavit zaak).
- REDEN:
een ‘communautaire’ regeling ontbreekt immers niet langer
MAAR UITZONDERINGEN HIEROP in art. 114, lid 4 VWEU & 114, lid 5 VWEU
Aan de hand van deze artikelen is het mogelijk om als LS af te wijken van de
harmonisatiemaatregel en nationale bepalingen te behouden of nieuw in te voeren.
● Art. 114, lid 4 VWEU (dia 15):
- Dit artikel heeft betrekking op de situatie waarbij een LS reeds een
hogere bescherming biedt (bv. op het vlak van volksgezondheid) dan
wat in de EU harmonisatieregel wordt voorzien.
Het moet gaan over een nationale maatregel die:
1) Reeds bestond ten tijde van het uitvaardigen van de EU
harmonisatiemaatregel
2) EN die gerechtvaardigd is als een gewichtige eis als vermeld in
art. 36 VWEU of verband houdt met de bescherming van het
milieu of het arbeidsmilieu (DUS GEEN ANDERE
DWINGENDE BEHOEFTE!!!)
