(i) Facts of the Case (5)
Mrs. Gumede was married to Mr. Gumede under the KwaZulu-
Natal Codes of Zulu Law, which governed customary marriages.
In this system, women had no legal capacity to own or control
property, and upon dissolution of the marriage, women were not
entitled to any share of the matrimonial property. Mrs. Gumede
sought a declaration that the provisions of the Recognition of
Customary Marriages Act, 1998 (RCMA), which regulated the
proprietary consequences of customary marriages, were
unconstitutional. Specifically, she challenged Section 7(1) and (2)
of the RCMA, which differentiated between marriages entered
before and after the commencement of the Act, thereby subjecting
her marriage to the discriminatory rules of customary law.
