1. Main Acts of Legislation for Domestic Violence and Intimidation (2 Marks)
The two main Acts of legislation in South Africa applicable when dealing with domestic
violence and intimidation are the Domestic Violence Act, No. 116 of 1998 and the
Protection from Harassment Act, No. 17 of 2011. The Domestic Violence Act provides
a comprehensive framework for the protection of individuals who are victims of domestic
violence, offering mechanisms such as protection orders and arrest without a warrant in
cases of imminent harm. The Protection from Harassment Act extends these protections to
cases of harassment and intimidation, allowing victims to apply for protection orders to
prevent further harassment or intimidation from any individual, not limited to domestic
relationships.
