1.1. A) The Films and Publications Act 65 of 1996 regulates publications by making provision
for a system of classification. Name TWO possible classifications that can be given to
publications and indicate briefly when a publication will be awarded each of these classifications.

Two possible classifications that can be given to publications are:

 Refused Classification: A publication will be given this classification if it contains child
pornography, propaganda for war, incitement to imminent violence, or advocacy of hatred
based on any identifiable group characteristic that constitutes incitement to cause harm. If the
publication is a bona fide documentary or of scientific, literary, or artistic merit, or is on a
matter of public interest (except with respect to child pornography), this classification will not
apply.

 XX Classification: A publication will receive this classification if it contains explicit sexual
conduct that violates or shows disrespect for human dignity, bestiality, incest, rape, or conduct
that is degrading to human beings. This classification also applies if the publication incites or
promotes harmful behavior, or depicts extreme violence.

B) What is “virtual child pornography”? What is the legal position surrounding the issue of
virtual child pornography?

Virtual child pornography refers to computer-generated images or simulations that appear to depict
children in pornographic scenarios but do not involve real children. The legal position in South
Africa is that the definition of child pornography in the Films and Publications Act includes virtual
child pornography. The definition refers to "an image, real or simulated," thereby including virtual
depictions. However, the constitutionality of this prohibition may be challenged in the future.
