PARTICIPANTS OF THE CRIMINAL JUSTICE SYSTEMAll participants of the criminal justice system must work together to ensure that justice is served.
Each has a duty to ensure that it fulfils its mandate to ensure an effective and fair criminal justice
system.
Should one participant default in fulfilling its duties, it affects the entire functioning of our criminal
justice system.
For example, if the police do not conduct thorough investigations, it may lead to the prosecuting
authority deciding not to prosecute due to a lack of evidence (no prima facie evidence). This would
lead to the release of the accused which would amount to an injustice to the victims of the accused
and our entire society.
